Artist Commission Terms of Service



Notice on Artificial Intelligence Usage



All artwork created by the artist is protected from use in artificial intelligence systems. By commissioning, viewing, or interacting with the artist’s work, you acknowledge and agree that the artwork may not be used for training, prompting, analysis, modification, or generation by any artificial intelligence, machine learning, or automated image generation systems under any circumstances.



By commissioning artwork from the artist, the client agrees to the following Terms of Service.

1. Payment



Full payment must be received before any work on the commission will begin. The commission will not be scheduled or started until payment has been confirmed.



All prices are listed in the currency specified by the artist. Any transfer or transaction fees are the responsibility of the client unless otherwise stated.

2. Revisions



Revisions may only be made with the artist’s approval. Whether revisions are accepted depends on the stage of the project at the time the request is made.



Once the artwork has reached the coloring stage, revisions are significantly less likely to be accepted. If revisions are approved, additional fees may apply depending on the extent of the requested changes.



Corrections required due to artist error will always be made free of charge.

3. Deadlines and Delivery



Once payment has been received, the commissioner can expect their artwork to be completed within 2–4 weeks. The average completion time is approximately 2 weeks, though this may vary depending on communication speed, project complexity, or real-life circumstances.



The artist will make reasonable efforts to inform the client if significant delays occur.



Final artwork will be delivered digitally unless otherwise specified.

4. Use of Artwork



Commissioned artwork is for personal use only unless a commercial license has been explicitly discussed and agreed upon prior to use.



Clients may:



  • Post the artwork online with proper credit to the artist

  • Use the artwork as profile pictures, banners, or personal displays

  • Print for personal use



Clients may not:



  • Claim the artwork as their own creation

  • Sell, redistribute, or commercially exploit the artwork without permission

  • Use the artwork in merchandise, advertising, or promotional materials without a commercial license

  • Remove the artist’s signature or watermark if present



Commercial usage rights may be discussed separately and must be agreed upon before the artwork is used for any commercial purpose.

5. Prohibited Uses (AI and NFTs)



The following uses are strictly prohibited:



  • Minting, selling, or distributing the artwork as NFTs

  • Uploading the artwork to AI training datasets

  • Using the artwork with AI image generation systems

  • Altering, editing, tracing, modifying, or transforming the artwork using generative AI tools in any form

  • Using the artwork in any system designed to replicate, analyze, or generate images through machine learning



The artist does not support NFT trading or generative AI image systems, and the artwork may not be used in connection with them under any circumstances.

6. AI Dataset and Machine Learning Restrictions



The artist expressly prohibits the inclusion of their artwork in any dataset used for machine learning, artificial intelligence training, or automated content generation systems.



This includes, but is not limited to:



  • Image generation models

  • Style replication systems

  • Automated image analysis tools

  • Any dataset intended to train or improve generative AI systems



No individual, company, or organization is permitted to collect, reproduce, distribute, or store the artist’s work for the purpose of training or developing artificial intelligence models.

7. Automated Scraping and Data Collection



The artist does not grant permission for their artwork to be collected through automated means, including but not limited to:



  • Web scraping

  • Data mining

  • Automated crawlers or bots

  • Dataset harvesting tools



Any automated collection, archiving, or indexing of the artist’s work for dataset creation, AI training, or other automated systems is strictly prohibited without the artist’s explicit written permission.

8. AI Style Mimicry and Replication



The artist explicitly prohibits the use of their artwork, portfolio, or commissioned pieces for the purpose of training, prompting, or developing artificial intelligence systems intended to replicate or imitate the artist’s style.



This includes but is not limited to:



  • Training models designed to produce images “in the style of” the artist

  • Creating datasets intended to reproduce the artist’s stylistic characteristics

  • Using prompts, references, or training techniques intended to mimic or simulate the artist’s artistic identity



The artist’s style, techniques, and creative identity are considered part of their intellectual property and may not be replicated through artificial intelligence systems.

9. Character Ownership and Artwork Rights



If the commissioned artwork depicts a character owned by the client (such as an original character), the client retains ownership of that character and its concept.



However, the artwork itself remains the intellectual property of the artist. Ownership of a character does not grant ownership of the illustration, nor does it grant rights to reproduce, sell, or commercially distribute the artwork unless a commercial license has been explicitly agreed upon.



The artist retains full rights to the artwork as outlined in these Terms of Service.

10. Intellectual Property Rights



The artist reserves the right to decline any commission request for any reason without obligation to provide an explanation.



By commissioning the artist, the client is purchasing the artist’s labor and time only, not the copyright to the artwork. The artist retains full copyright ownership of all created works regardless of the stage of completion.



This includes, but is not limited to, the right to:



  • Display the artwork in portfolios, galleries, and social media

  • Use the artwork for promotional purposes

  • Share the artwork publicly

  • Reproduce or sell the artwork as prints or merchandise



The artist also reserves the right to modify and resell rejected sketches at a later date as “pre-posed” or pre-made designs.

11. Posting and Credit



The artist reserves the right to post commissioned artwork on social media, portfolios, or promotional platforms unless a prior agreement has been made with the client.



When sharing the artwork publicly, the client must provide clear credit to the artist and may not remove any visible watermark or signature.

12. Refunds and Cancellation



Clients are encouraged to review the artist’s style carefully before commissioning.



If the client decides to cancel the commission after work has begun, the refund amount will be determined based on the current stage of completion. The cost of completed work will be deducted and the remaining balance will be refunded.



If the artist must cancel the commission for any reason, the client will receive a full refund for any work that has not yet been completed.

13. Chargebacks



Clients agree not to initiate payment chargebacks once work has begun. If a chargeback is attempted after work has started or after artwork has been delivered, the client forfeits all rights to the artwork and may be barred from commissioning the artist again.



The artist also reserves the right to publicly blacklist clients who commit fraudulent chargebacks.

14. Client Conduct



The artist reserves the right to refuse or cancel a commission if a client behaves in a hostile, disrespectful, or abusive manner.



Harassment, excessive pressure for updates, or attempts to bypass the Terms of Service may result in immediate cancellation of the commission.



Refunds in these situations will be determined based on the stage of work already completed.

15. Age Requirement



Clients must be 18 years of age or older to commission the artist. By submitting a commission request or payment, the client confirms that they meet this requirement and are legally able to enter into this agreement.



The artist reserves the right to refuse or cancel commissions if the client is found to be under the age requirement.

16. Agreement to Terms



By submitting payment, requesting a commission, or otherwise engaging the artist’s services, the client confirms that they have read, understood, and agreed to these Terms of Service in full.



This agreement becomes binding at the time the commission request is accepted and payment is received.

17. Governing Law and Jurisdiction



These Terms of Service are governed by and interpreted in accordance with the laws of the United Kingdom.



Any disputes arising from commissions or agreements with the artist shall be subject to the jurisdiction of the courts within the United Kingdom.

18. Communication



Communication regarding commissions should be conducted through email or VGen (depending on which platform the commission was requested) whenever possible to ensure clear and organized correspondence.



Timely responses from the client are appreciated and may help prevent delays in the completion of the artwork.

By commissioning the artist, the client confirms that they have read, understood, and agreed to these Terms of Service.
